Terms of Service

These Terms of Service ("Terms") govern your access to and use of houseofexodus.co (the "Site") and any purchases you make from EXODUS, operated by House of Exodus LLC. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Site and make purchases. By using the Site you represent that you meet these requirements.

2. Products and Pricing

• We strive to display products, colors, and descriptions accurately, but we do not guarantee that all details are error-free or current.
• Prices are listed in US dollars and may change at any time without notice.
• We may limit or cancel quantities purchased per person or per order, and we may refuse or cancel any order at our discretion, including suspected fraud.

3. Orders and Payment

Orders are processed through Shopify. When you place an order you authorize us to charge your selected payment method for the total amount, including taxes and shipping. An order confirmation does not guarantee acceptance; we may decline or cancel an order and issue a refund if needed.

4. Shipping

Estimated shipping times are not guaranteed. Risk of loss passes to you once the order is handed to the carrier. You are responsible for any duties, import taxes, or fees on international shipments.

5. Returns and Refunds

Returns and refunds are governed by our Return Policy, which is incorporated into these Terms by reference. Please review it before purchasing.

6. Health Disclaimer

EXODUS products are apparel made from organic cotton. Any statements about comfort, materials, or wellbeing are provided for general informational purposes only and are not medical advice. Our products are not intended to diagnose, treat, cure, or prevent any disease or condition. Individual experiences differ and results may vary. Consult a qualified healthcare provider with any questions about your health.

7. Intellectual Property

The Site and all content on it, including the EXODUS name, logo, text, graphics, images, and code, are owned by us or our licensors and are protected by intellectual property laws. You may not copy, reproduce, or use them without our prior written permission.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, other accounts, or our systems.
• Interfere with or disrupt the Site, or introduce malicious code.
• Scrape, harvest, or collect data from the Site without our permission.

9. User Content

If you submit reviews, messages, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our business. You are responsible for the content you submit and represent that it does not violate any third-party rights.

10. Disclaimers and Limitation of Liability

The Site and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. To the maximum extent permitted by law, EXODUS and House of Exodus LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.

11. Indemnification

You agree to indemnify and hold harmless EXODUS, House of Exodus LLC, and our officers, employees, and agents from any claims or expenses arising out of your violation of these Terms or misuse of the Site.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration provision below, any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

13. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights. Except for disputes that qualify for small claims court, you and House of Exodus LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our products will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as JAMS or the American Arbitration Association) under its applicable consumer rules. The arbitration will take place in Los Angeles County, California, or another mutually agreed location, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and House of Exodus LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

30-day opt-out. You may opt out of this arbitration provision by emailing ben@houseofexodus.co within 30 days of first accepting these Terms, stating your name and intent to opt out. If you opt out, the Governing Law section above applies to your disputes.

14. Miscellaneous

• Severability. If any provision of these Terms is found unenforceable, the remaining provisions will stay in full force and effect.
• Entire Agreement. These Terms, together with our Return Policy and Privacy Policy, are the entire agreement between you and us regarding the Site and supersede any prior understandings.
• Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Termination. We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

15. Changes to These Terms

We may update these Terms at any time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes means you accept the updated Terms.
